Tom Teaches English — Terms of Use

Effective date: 7/8/2026

These Terms of Use ("Terms") govern your access to and use of ttenglish.com.au (the "Site") and the online English language teaching services provided by Tom Teaches English ("we", "us", "our"), operated by Thomas Chambers as a sole trader (ABN 62 573 807 031). By creating an account, purchasing a subscription, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. About Us

Tom Teaches English is an online English language teaching subscription service, providing live group classes via Zoom and an asynchronous library of pre-recorded video lessons, taught by a CELTA-certified teacher. Our services are aimed at adult learners of English (18 years and over) worldwide.

2. Eligibility and Accounts

  • You must be at least 18 years old to create an account and purchase a subscription. If you are under 18, a parent or legal guardian must register and supervise your use of the Site.

  • You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account.

  • You agree to provide accurate, current, and complete information when registering, and to keep that information up to date.

3. Subscription Plans and Fees

We offer the following plans, as described on the Site from time to time:

  • A 3-day free trial of the Live Classes plan, giving full access to live classes and the video lesson library for the trial period.

  • A paid async-only plan, giving access to the full video lesson library.

  • A paid live plan, giving access to all live class levels (one class per day) plus the full video lesson library.

Current pricing is displayed on the Site in Australian Dollars (AUD) and may be updated from time to time. We will give you reasonable notice of any price change before it takes effect for your subscription.

Subscriptions renew automatically each billing period unless cancelled before the renewal date. Payments are processed securely by third-party payment providers (Stripe and/or PayPal) — see our Privacy Policy for details. We do not store your full payment card details.

4. Cancellations and Refunds

  • You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period; you will retain access until that date.

  • Fees already paid are generally non-refundable, except where required by applicable consumer law (including the Australian Consumer Law) or as we otherwise agree at our discretion.

  • We reserve the right to change, suspend, or discontinue any part of the service, including specific class levels or content, with reasonable notice.

5. Live Classes

  • Live classes are delivered via Zoom using access details provided through your account. Access is tied to your active subscription and is personal to you — meeting links and registration details must not be shared with non-members.

  • Class schedules, levels, and formats may change from time to time; we will make reasonable efforts to notify members in advance of material changes.

  • You are responsible for having a suitable device, internet connection, and Zoom access to attend live classes.

  • We may record parts of live sessions for quality, moderation, or content purposes. Where this occurs, it will be communicated to attendees.

6. Acceptable Use

When using our services, you agree not to:

  • Share your account, login details, or class access links with anyone else.

  • Record, reproduce, redistribute, or resell any class content, video lessons, or materials without our written permission.

  • Behave in a disruptive, abusive, or harassing manner towards the teacher or other students, whether in live classes, breakout rooms, or written submissions.

  • Use the service for any unlawful purpose or in a way that infringes the rights of others.

  • Attempt to gain unauthorised access to our systems, other users' accounts, or the underlying platform (Wix, Zoom, or otherwise).

We may suspend or terminate access for any user who breaches these Terms, with or without notice depending on the severity of the breach.

7. Loyalty and Referral Program

We may operate a loyalty points and/or referral program from time to time, allowing members to earn points for actions such as referrals, reviews, or engagement, redeemable against future subscription fees. Full current terms of any such program (including point values, expiry, and eligibility) will be published separately on the Site and form part of these Terms by reference. We reserve the right to modify, suspend, or discontinue any loyalty or referral program at our discretion, subject to honouring points already earned wherever reasonably possible.

8. Intellectual Property

All class content, video lessons, homework materials, branding, and Site content are owned by us or our licensors and are protected by copyright and other intellectual property laws. Your subscription gives you a limited, non-exclusive, non-transferable licence to access this content for your personal learning use only, for as long as your subscription remains active.

9. No Professional or Guaranteed Outcomes

While our classes are taught using CELTA-based methodology, we do not guarantee any specific learning outcome, proficiency level, or exam result. Language learning progress depends on many factors outside our control, including individual effort and prior experience.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, our services are provided "as is" without warranties of any kind, whether express or implied. We do not warrant that the Site or Zoom classes will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or our services is limited to the amount you paid us in the three (3) months preceding the claim. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

11. Termination

We may suspend or terminate your account and access to the service if you breach these Terms, engage in fraudulent or abusive conduct, or if required to do so by law. You may terminate your account at any time in accordance with Section 4.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will post the updated Terms on the Site with a revised effective date. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for any dispute arising from these Terms, except where mandatory local consumer protection laws provide otherwise.
